What Are the Biggest Differences?
If you've bought or sold real estate in one country, you may assume the process is similar everywhere. In reality, every market has its own customs, regulations, and expectations. As someone who works with clients from many different backgrounds, I’m often asked how real estate transactions in California compare to those in Brazil—especially Rio de Janeiro.
While both markets offer incredible opportunities, understanding the differences can help buyers and sellers feel more confident throughout the process.
1. Representation and Professional Guidance
In California, buyers and sellers commonly work with licensed real estate professionals who guide them through pricing, negotiations, disclosures, inspections, and escrow. Transactions follow well-established procedures designed to promote transparency.
In Rio de Janeiro, licensed real estate professionals also play an important role, although the transaction process may differ in structure, documentation, and negotiation practices depending on the property and the parties involved.
2. The Transaction Process
One of the biggest differences is how the transaction is completed.
In California, the sale typically moves through an independent escrow process. Escrow serves as a neutral third party that coordinates documents, funds, and deadlines before ownership transfers.
In Brazil, transactions generally conclude through a notary office (Cartório), where legal documents are finalized and property ownership is officially registered.
Both systems are designed to provide legal certainty, but they operate very differently.
3. Property Disclosures
California places significant emphasis on seller disclosures. Sellers are generally expected to disclose known material facts about the property's condition, helping buyers make informed decisions.
Brazil also requires documentation and transparency, but disclosure practices and required documentation may differ from those commonly seen in California.
4. Financing
Mortgage financing is widely used in both countries, but qualification requirements, loan structures, interest rates, and lending practices can vary considerably.
Because financing programs evolve over time, buyers should consult qualified lenders in the country where they plan to purchase.
5. Closing Costs
Closing costs are another area where buyers are often surprised.
In California, closing expenses are typically shared between buyer and seller according to the purchase agreement and local practices.
In Rio de Janeiro, buyers often assume a larger portion of transaction costs, including transfer taxes and registration fees, although every transaction is unique.
6. Market Expectations
California's market is highly data-driven. Pricing strategies often rely on comparable sales, local inventory, buyer demand, and current market conditions.
Rio de Janeiro combines market data with neighborhood-specific characteristics, lifestyle preferences, and local demand. As in any city, pricing can vary significantly from one neighborhood to another.
